Welcome to Kreuzberg (“Kreuzberg,” “we,” “us,” or “our”). By accessing or using our website (the “Site”) and hosted services, you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Site.

Use of the Website

You agree to use the Site only for lawful purposes. You must not misuse the Site, including but not limited to attempting unauthorized access, disrupting services, reverse-engineering, or engaging in malicious activity.

Account Sign-Up and Communications

By signing up, you consent to receive emails from us, which may include updates, onboarding materials, product information, and occasional promotional communications. You may unsubscribe from marketing emails at any time using the unsubscribe link included in every marketing email.

Service-related emails (e.g., account notices, service changes) are necessary for the proper functioning of our services.

Analytics and User Behavior Tracking

By using our website or our hosted product, and subject to your consent via the cookie banner, you acknowledge that we use third-party analytics tools, including Segment (as a customer data platform) and Mixpanel (as a downstream Segment destination reached server-side) to collect and analyze behavioral and usage data. This data helps us understand how users interact with our product, measure feature adoption, and improve performance and user experience.

These tools collect data such as page views, feature interactions, click events, session metadata, and navigation patterns. Analytics tracking is activated only after you provide consent via the cookie banner or your preferences. Payments and Subscription

Paid plans are billed through Stripe, which acts as Merchant of Record for transactions originating in the European Economic Area. By subscribing, you agree to Stripe’s terms of service and authorise Stripe to charge your selected payment method on a recurring basis according to your chosen plan. Stripe handles tax calculation, invoicing, refunds, and chargebacks in line with applicable law. Subscription cancellation, plan changes, and refund requests can be made from your account dashboard or by contacting billing@kreuzberg.dev. Where you cancel mid-cycle, service continues until the end of the paid period; pro-rata refunds are not provided unless required by law.

Intellectual Property

All content and materials available on Kreuzberg, including text, graphics, logos, software, designs, and branding, are owned by Kreuzberg or our licensors and are protected by intellectual property laws. You may not reproduce, distribute, modify, publicly display, or otherwise exploit any content from the Site without prior written consent from Kreuzberg.

Open-Source Software and MIT License

Kreuzberg includes open-source software components that are released under the MIT License. Your use of the open-source Kreuzberg code is governed by the applicable open-source license terms (including the MIT License), not by these Terms. These Terms apply to the Kreuzberg website and any hosted services we may provide, and do not restrict your rights under the MIT License.

Disclaimers and Limitation of Liability

The Site and all associated content, services, and information are provided “as is” and “as available.” Kreuzberg makes no representations or warranties regarding the accuracy, reliability, completeness, or suitability of any information or content provided on the Site.

To the maximum extent permitted by law, Kreuzberg shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or reliance on any information provided herein. Nothing in these Terms excludes liability for death or personal injury caused by our negligence or for other liabilities that cannot be excluded by law.

Changes to Terms

Kreuzberg may update these Terms from time to time. We will post the updated Terms on this page with a revised “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to them are governed by the laws of Germany and EU law. For any disputes that cannot be resolved amicably, the courts of Germany shall have exclusive jurisdiction to the extent permitted by law.
